Terms of Service

Last updated: October 31, 2026

1. About these terms

These terms are the agreement between you and MailSketch, based in India ("MailSketch", "we", "us"), for your use of the MailSketch website and email design tool (the "Service"). By creating an account or using the Service, you agree to them. If you do not agree, do not use the Service.

2. What MailSketch is, and is not

MailSketch is an independent tool for designing emails. You pick a template, edit it visually, check it, and export clean HTML. MailSketch is not an email service provider, a campaign sender or a CRM: you send your email with the platform you already use. We do not send your emails for you.

3. Your account

You need an account to save projects. Keep your password private and tell us if you think someone else has used your account. You are responsible for what happens under your account. You must give us a real email address that you can receive mail at.

4. Who can use the Service

You must be at least 16 years old. If you use MailSketch for an organization, you confirm that you may bind it to these terms.

5. Your content

You own the content you create or upload: your designs, text, brand kit and images ("Your Content"). You give us the permission we need to store it, process it, show it back to you and export it, only to run the Service for you. We do not sell Your Content. We do not use it to train AI models.

You are responsible for Your Content. You promise that you have the rights to use it and that it does not break the law or anyone else's rights.

Working with others. In a workspace you share, the other members can see Your Content, see who is editing an email at the same time, and see earlier versions of an email in its version history, with the name of the person who saved each one. On plans that include them, a share link lets anyone who has the link view that email without signing in, until you turn the link off.

6. Templates and other things we provide

MailSketch provides ready-made email templates, blocks, icons and sample images. You may use them in the emails you create with the Service, for yourself or your clients. You may not resell or redistribute the templates themselves as templates, or present them as your own template product.

Some template images may be made with AI tools.

7. Acceptable use

Do not use the Service to:

  • break the law, or send or host illegal content;
  • create or share abusive, harassing, deceptive or fraudulent content, including phishing;
  • send spam or bulk unsolicited email, or help anyone else do so;
  • upload malware, or content you do not have the right to use;
  • use the image links the Service gives you as a general image host for anything other than the emails you build;
  • attack, overload or probe the Service, get around its limits, or use it to harm others;
  • try to get into other people's accounts or data.

We may remove content and suspend or close accounts that break these rules, and we may report illegal content to the authorities.

8. Emails you send: your responsibility

When you export an email and send it, you are the sender. You must follow the laws that apply to your email, for example including your real sender identity and a working unsubscribe link in marketing email, and only emailing people you may email. MailSketch's Email check looks for common problems such as a missing unsubscribe link, missing alt text, low contrast and very large size, and tells you what to fix. It does not give legal advice, and it does not promise how your email will look or where it will land.

9. Images you upload

Images used in your emails can be viewed by anyone who has their link, so that email programs can show them. Some email programs keep copies of images, and we cannot remove those copies; the Privacy Policy says how we keep and delete images.

10. Features that may change

MailSketch includes AI-assisted email drafting, sending a test email, direct export to Klaviyo and Mailchimp, free stock photos from Pixabay, image upload and share links for review. Some of them depend on your plan, as our Pricing page shows. We may change, improve or switch off features over time.

When you use AI-assisted drafting, only the brief you write is sent to the AI provider (see the Privacy Policy).

AI allowance. Each plan includes a monthly AI allowance, shared by everyone in the account owner's workspaces. At today's rates, the Core plan's allowance covers at least 15 full AI emails a month, and the Free plan's at least 2 full AI emails. Your plan's allowance never shrinks, and what you don't use doesn't carry over. How much of the allowance a full email uses can change, for named reasons only, such as a change in what the AI provider charges us: a decrease applies at once, and an increase applies only after 30 days of notice. We never re-price what you have already used.

11. Plans, payment and refunds

Free to start. No credit card. The Free plan costs nothing. Paid plans are lifetime plans: one payment, not a subscription, for as long as MailSketch is offered. What each plan includes is listed on our Pricing page and in the Lifetime Deal Terms; when you buy, we record your plan's limits on your account, and a later change to what new buyers get does not change them.

Lifetime plans are a launch offer. We may later offer subscriptions to new customers; that doesn't change a lifetime plan you have already bought.

Payments are handled by Dodo Payments, the merchant of record for your purchase, under its own terms. Any sales tax or VAT is calculated by our payment provider, Dodo Payments, at checkout. Refunds follow our Refund Policy.

If a plan ends (for example after a refund), your account moves to the Free plan. Nothing you made is deleted.

12. Support

We offer support by email at support@mailsketch.com. We aim to reply within 2 business days. Support does not include designing custom templates for you unless we agree that separately. We may ask for IDs or details about your project to help you; we do not read the content of your emails unless you ask us to, it is needed to fix a problem you report, or to investigate a report of abuse or enforce these terms.

13. Changing or ending the Service, and your data

You can stop using MailSketch at any time. You can export your projects as HTML or a ZIP. If you delete a workspace, you can restore it for 30 days. You can delete your account with Delete account in your account settings: you are signed out and the account is locked at once, and the Privacy Policy says what is deleted and when. We may suspend or end your account if you break these terms, the Acceptable Use Policy or the law, or to protect the Service or other people. We may change, pause or retire parts of the Service. If we ever stop offering MailSketch, we will tell you at least 90 days before it ends and give you a way to export your work.

14. No guarantees

The Service is provided "as is" and "as available". To the extent the law allows, we make no other promises about it. Nothing in these terms takes away rights you have under consumer law that can't be excluded.

We work to keep MailSketch available and your projects safe, but we cannot promise that it will always work without interruption or errors, or that your email will look the same in every email program.

15. Limits on our responsibility

To the extent the law allows, we are not responsible for indirect losses, such as lost profits, lost business or lost data, and our total responsibility for any claim is limited to the amount you paid us in the 12 months before it, or US$50 if you haven't paid us. Nothing here limits responsibility that the law doesn't allow us to limit.

16. Indemnity

If someone makes a claim against us because of content you put into MailSketch or emails you send with it, in breach of these terms, you agree to cover our reasonable costs of that claim.

17. Changes to these terms

We may update these terms. We will post the new version here with a new "Last updated" date. We'll tell you before important changes take effect, by email or in the product. If you keep using the Service after a change takes effect, you accept it.

18. Governing law

These terms are governed by the laws of India.
